Minnesota
- Minnesota Statute §123A.21 is the enabling legislation of the service cooperatives. It defines that the service cooperative role is to provide programs and services that meet the needs of members. Cooperative purchasing is one of those programs.
- Minnesota Statute §471.345 Subd 15 (b) Cooperative purchasing states: “A municipality may contract for the purchase of supplies, materials, or equipment without regard to the competitive bidding requirements of this section if the purchase is through a national municipal association’s purchasing alliance or cooperative created by a joint powers agreement that purchases items from more than one source on the basis of competitive bids or competitive quotation.” This defines how members can purchase from the contracted vendors while staying in compliance with the competitive bidding requirements.
- The two statutes combined meet Minnesota's competitive bidding requirements and gives members the ability to purchase from our vendors.
New Jersey

P.L. 2011, c.139 (the “Law” or “Chapter 139”) allows local contracting
units (counties & schools) to utilize national cooperative contracts as a method of procurement - NJ Title-52 Section-52-34-6-2 Subsection 7.b.(3) (National Cooperative Contracts) is essentially unchanged as of 2022.
